Federal Circuit Court Issues Mixed Ruling in Philips Lumileds' Patent Infringement Case Against Epistar

May 26, 2009... The U.S. Court of Appeals for the Federal Circuit reportedly confirmed the U.S. International Trade Commissions ruling that Epistar infringed upon Philips Lumileds' U.S. U.S. Patent No. 5,008,718 (the '718 patent). Epistar previously merged with United Epitaxy Corporation (UEC).
The Federal Circuit also upheld the ITC's decision that "Epistar (as a successor to UEC) may not contest validity of the '718 patent with respect to the UEC products that it inherited in the merger."
The article on June 8, 2009, incorrectly stated that the Federal Circuit had upheld rather than overturned the ITC ruling that Epistar could not contest validity with respect to other products. This apparently opens the door for Epistar to bring patent '718 validity challenges against other products.
Despite this, Philips Lumileds asserted that any further invalidity challenges by Epistar to the '718 Patent will be rejected.Philips Lumileds News Release,
